4th woman testifies against defendant in second indecent assault case
A fourth woman testified Tuesday that a Boyers man made her feel uncomfortable by tickling her, smacking her buttocks and rubbing her body when she was visiting his home at age 16.
The woman involved in the of the second indecent assault case against Shawn D. Berkstresser, 54, is now 20 years old.
Berkstresser is on trial in Common Pleas Court in this case and another case, which saw three woman testify about similar alleged touching and rubbing when one woman was 18 and the other two were minors in incidents from 2017 to 2022. The trial started Monday and will resume Wednesday.
The woman in the second case said she went to Berkstresser’s home for visits, and he touched and rubbed her “a couple times.”
She testified Berkstresser pretended to tickle her because he wanted to touch her. On one occasion, he slapped her buttocks when she walked past him, she said. On another occasion, he stated tickling her and then grabbed her inner thighs. She testified that he started rubbing her thighs and then worked his way to other parts of her body. She said he rubbed her over the clothes she was wearing.
She testified that she didn’t tell him to stop or do anything to stop him.
“He always made me feel uncomfortable,” she said.
She also testified that she saw Berkstresser slap the buttocks of one of the other girls involved in the first case and walk into a bathroom after she entered.
State police Cpl. Max DeLuca testified about an interview he and Trooper Phillip Schneider, the lead investigator in the case, conducted with Berkstresser on Nov. 21, 2022. The interview took place in a police vehicle outside of his home while other troopers executed a search warrant in the home. A recording of the two-and-a-half hour interview was played in court.
In the recording, Berkstresser said he believed that allegations of sexual contact made by one of the girls in the first case were made “due to spite” and he denied having sexual contact with any of them.
Responding to another question, Berkstresser said he would not be surprised to learn that all three of the girls reported he had sexual contact with them.
He said touched one of the girl’s hips and buttocks to look at bruises she sustained playing sports and called it a “clinical examination.”
Berkstresser said he applied lotion on one of the girl’s breasts because she had eczema there and other parts of her body.
“It’s clinical to me,” he said in the recording.
He said he gave whole body massages more than 10 times to one of the girls while she was naked, massaged another one of the girls while she was topless once and rubbed the back and legs of another one of the girls while she was nude or wearing underwear.
Schneider testified about an activity log that Berkstresser kept on his computer that was seized as evidence.
Focusing on the time from February 2017 and November 2022, Schneider noted log entries in which Berkstresser wrote about rubbing, scratching, massaging and applying skin lotion on the three girls in the fist case. In some of the log entries, he said he did those things to address skin problems, sore shoulders and backs and, in one entry, insect bites.
In another entry he wrote that he became “mesmerized” by rubbing one of the girls.
Berkstresser is facing a felony count of indecent assault of a person younger than 13, two counts of corruption of minors and two counts of endangering the welfare of children, and four misdemeanor counts of indecent assault in the case involved three girls. In the second case, he is charged with a misdemeanor count of indecent assault and summary harassment.
